There's no evidence for that from the log file you have sent.  It's
definitely in data mode, then gets some <DLE> stuff, and goes to data mode
from there (didn't keep the log, but it clearly answered in voice mode).

Please try again, describe exactly what happens, and send the
corresponding log file.
