For mgetty users with non-trusted shell logins

I don't understand how this root-only-reopen works. Let me see how i
understand it.

fcntl to the open tty that only root can reopen.
hangup
file is closed. (refering to dev off course)
since the file has closed, the reference that it can only be reopen by
root is lost

I thought that fcntl only applies to files, and not to devices. Or you are
somehow trying to implement this at the driver level? (the one that
manages the device)
