I reply:

Brother Harrell, God does not deal in theory.  He is simply saying that if
we can't settle it before the church, then turn it over to Him.  In NO
circumstances should one believer take another believer before a court of
law.  Even if the offended Brother is in the "right" he becomes in the
"wrong" when he takes him before the court of law.
